These General Terms and Conditions define the terms under which the Agency enters into an agreement with the Guest, with the respective legal responsibilities differing accordingly. For accommodation service reservations, the Agency acts as an intermediary (in the sale of accommodation). All information stated in these General Terms and Conditions constitutes a legal obligation for both the Agency and the Guest.

Offer Details

The Agency provides the service in accordance with the information published online and valid on the date of the booking confirmation, as well as according to the description and period specified in the confirmed reservation, except in cases of force majeure, such as illness or death of the service provider or their immediate family member, or extraordinary circumstances that cannot be foreseen or prevented (natural disasters such as earthquakes, floods, public health emergencies, fires, droughts, wars, strikes, terrorist attacks, and government-imposed restrictions such as mobilization or a ban on leaving the country).

Reservations, Payments and Cancellations

Accommodation inquiries and reservations are accepted electronically and by telephone. By submitting an accommodation reservation request or making an accommodation reservation, the Guest confirms that they are familiar with these General Terms and Conditions for the provision of services, have carefully reviewed them in advance, and fully accept them. All provisions set out in these General Terms and Conditions constitute a legal obligation for both the Guest and the Agency.

Accepted payment methods are:

a) Credit card (MasterCard, Visa, Maestro, American Express, Apple Pay, Google Pay, PayPal)
b) Bank transfer

For reservations made 30 days or more before the start of the rental period, the following conditions apply:

A 30% advance payment (unless otherwise stated) of the total agreed accommodation price must be paid by the Guest immediately if payment by credit card is selected. If payment by bank transfer is selected, NOMA 22 d.o.o. must receive the advance payment within 3 (three) business days.

The remaining 70% (unless otherwise stated) of the total agreed accommodation price must be paid by the Guest no later than 30 (thirty) days before the start of the rental period if payment is made by credit card or bank transfer. If cash payment is selected (in villas where this is permitted and indicated on the NOMA 22 d.o.o. website), the Guest shall pay the remaining 70% immediately upon arrival directly to the owner. Electronic payment at the villa (credit card / PayPal) is not available.

For reservations made 30 days or less before the start of the rental period, the following conditions apply:

The total rental amount must be paid by the Guest immediately by credit card or bank transfer.

If the Guest fails to pay the remaining reservation amount within the agreed period, the Agency reserves the right to cancel the reservation after prior notification to the Guest. If the reservation is cancelled 30 or more days before the arrival date, the Guest is entitled to a refund of 70% of the total reservation amount. Guests may cancel their reservation by sending an email to the Agency.

The Guest is required to make the payment by bank transfer to the Agency’s account. The Guest is fully responsible for all bank charges imposed by both the sender’s bank and the recipient’s bank.

Note regarding credit card payments: All payments are processed in euros. When the Guest’s credit card is charged, the corresponding amount is converted into the Guest’s national currency according to the applicable exchange rate of the card association. As a result of the currency conversion, there may be a minor difference between the amount charged and the original price displayed on the Agency’s website.

Service Price

The accommodation price includes the basic services as described in the price list provided for the accommodation unit specified in the reservation. For private accommodation bookings, the price includes electricity, water and gas consumption, bed linen, towels, final cleaning and swimming pool maintenance. Service prices are quoted in EUR. The Agency reserves the right to change the published prices. For guests who have paid a deposit or the full amount for a particular reservation, the Agency guarantees the accommodation price stated in the price calculation on the basis of which the payment was made.

Promotions and discounts cannot be combined or accumulated; only one discount may be applied per reservation.

Security Deposit in Case of Damage

The security deposit in case of damage is mandatory for villas and holiday homes. After the Guest’s departure, and following a thorough cleaning and inspection of the property, the deposit will be fully refunded to the Guest, provided that no damage has been found, using the same payment method by which it was paid. If the security deposit in case of damage was paid into the Agency’s account, the corresponding amount will remain reserved in the Agency’s account for up to two business days after the Guest’s departure. The Guest is directly responsible to the owner for any damage caused, and the owner has the right to use the security deposit to cover the cost of such damage. If the security deposit does not cover the full amount of the damage, the Guest is obliged to pay the difference, up to the total amount of the damage, directly to the owner. The amount of the mandatory security deposit in case of damage is stated to the Guest in the breakdown of the total reservation amount during the booking process. Additional cleaning required due to particularly poor conditions in which the Guest has left the villa may also be considered damage, and the owner/Agency has the right to use the security deposit in case of damage to cover the cost of such damage.

House Rules

Guests are required to comply with the house rules. Each villa has its own house rules, which are displayed in a clearly visible place in the villa and are available to the Guest. Failure to comply with the house rules may be considered a serious breach of the Rental Agreement. In such a case, the owner and/or the Agency have the right to terminate the Rental Agreement with immediate effect and without notice. The Guest is required to permanently leave the villa together with all other guests within 2 (two) hours and shall not be entitled to request a refund of the accommodation price already paid from either the owner or the Agency.

Capacity

If more people arrive at the reserved accommodation unit than stated at the time of booking, the service provider has the right to refuse accommodation to the unregistered persons or to accommodate all persons subject to an additional charge for the unregistered persons, payable on site.

Pets

For accommodations where pets are welcome, an additional fee must be paid in cash on site directly to the service provider. Please contact the Agency for the exact calculation of the additional fee.

Pet owners are responsible for cleaning up after their pets. Pets are not allowed on the furniture at any time. Any evidence of a pet having been on the furniture may result in additional charges. Furthermore, pets are strictly prohibited from entering the pool or jacuzzi.

All pets must be vaccinated against rabies and all other required diseases in accordance with applicable regulations. Guests are advised to take all necessary precautions to protect their pets against common diseases and to ensure their well-being. The Guest is solely responsible for the care and safety of their pets, and neither the owner nor the Agency assumes any liability for any injuries and/or illnesses that pets may suffer during their stay in the villas.

Pets are not allowed in some villas. However, neither the owner nor the Agency can guarantee that no pets have previously stayed in the villa. The Agency assumes no responsibility for any allergic reactions that guests may experience during their stay in the villa.

Service providers in properties where pets are not allowed reserve the right to refuse the booked service to the Guest if the Guest brings a pet into the accommodation. In such cases, the Agency is not obliged to consider any complaints made by the Guest regarding the quality of the reserved accommodation or services.

Surroundings

Guests should be aware that some of our villas are located in rural or remote areas of Croatia. Therefore, guests may encounter local flora and fauna such as mosquitoes, wasps, ants, etc., as well as activities such as agriculture, livestock farming, drainage works, etc. The Agency cannot be held responsible for any construction or road works, works on houses, or similar activities in the immediate vicinity of the villa. If the Agency has prior knowledge of such works, it will inform its guests accordingly. However, this is not always possible, as works may commence at any time without our prior knowledge.

Categorization and Description of Services

The accommodation units offered are described according to the official categorization of the competent institution appointed by the Republic of Croatia, as well as based on the inspection of the actual condition of the accommodation by an Agency representative at the time of publication. Standards for accommodation, services and other amenities vary between locations and countries and are not comparable.

The Guest is required to follow all instructions regarding the use of the pool (if available at the villa) provided by the owner or the Agency for their own safety. The Guest uses the pool at their own risk and is responsible for any incidents related to the pool in every respect. Children must not be near or in the pool without adult supervision. If the villa is booked outside the summer season, the pool may not be in operation.

The Guest uses the jacuzzi (if available at the villa) at their own risk and should be aware of certain health risks associated with its use. The water in the jacuzzi may not be fully heated until late in the evening on the Guest’s arrival day. Standing on the jacuzzi covers is prohibited, as they are not designed to support the weight of a person and can easily be damaged or broken. If the cover is damaged or broken, the Guest is required to compensate the owner directly for the resulting damage.

Handling Complaints

Every Guest has the right to file a complaint regarding a contracted service that has not been provided. If the services included in the booking have been provided inadequately, the Guest is required to report the inadequate service immediately on the day of arrival and notify the Agency by email at info@noma22.com. Any legal disputes shall be subject to the jurisdiction of the Commercial Court in Zadar, permanent service in Šibenik.
